By visiting our site and/or purchasing something from us you engage our “Service” and agree to be bound by the following terms and conditions (“Term of Service”, Terms”) including those additional terms and conditions and policies referenced herein and/or available. These Terms of Service apply to all users of this site, including without limitations users who are browsers, vendors, merchants, and/or customers.

SECTION 1.  DEFINITIONS:

As used here, the following terms have the following meanings:  The term Agreement”  means these Terms and Conditions for Metal Solutions USA, LLC Product Sales (“Terms and Conditions”), together with all documents specifically referenced herein and written purchase order, pricing sheet, web-site order, or agreement which attaches, incorporates or otherwise reference these Terms and Conditions. The term “Buyer” means the individual, corporation, partnership, limited liability or other legal entity that has submitted an order to Metal Solutions USA

By agreeing to these Terms of Service you represent that you are at least the age of majority in your state or province of your residence or that you the age of majority in your province of residence and you have given us your consent to allow any of your minor dependents to use the site. You may not use our products for any illegal or unauthorized purpose nor may you in the use of the Service, violate any laws in your jurisdiction.

 

SECTION 2.  GENERAL CONDITIONS:

We reserve the right to refuse services to anyone for any reason at any time. We understand that your consent ( not including credit card information) may be transferred unencrypted and involve (a) transmissions over various networks and (b) changes to confirm and adopt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over network.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Products and Service, or access to the Service or any contact on the website through which the service is provided without express written permission by Metal Solutions USA, LLC.

 

SECTION 3.  PRICE & PAYMENT

Unless Metal Solutions Credit Department approves credit terms for Buyer, Buyer shall pay for products purchased in cash, in advance (PIA). We accept VISA, MASTERCARD, and DINNERS at time of order of products or service.

 

SECTION 4. ORDER CONFIRMATION:

As soon as your order is placed you will receive an order confirmation email. This confirms your order has been received in our system and your credit card is authorized for purchase. As soon as we receive your order we begin processing to confirm that it is in stock and we will process the charges and submit a shipment date.

 

SECTION 5.  LEAD TIME

For the purpose of these Terms and Conditions, “Lead Time” means the time period in calendar days between the date on which Metal Solutions receives an Order from Buyer and Buyer’s requested delivery date.  Unless otherwise agreed to in writing by the parties, the Lead Time for delivery of ordered products by buyer pursuant to an order, at the location specified in relevant Order, is 15 days from the date of such Order.

 

SECTION 6.  ORDER SHIPMENT:

Please reference product lead times. After shipment items will arrive 2-7 business days. Certain items due to size that can’t ship (UPS or FEDEX) will be required to ship via freight delivery. You will receive a call from the shipping company to arrange a time and day for delivery that works for you.

Unless different shipping terms are specified on the face of the relevant Confirmation, products will be shipped to buyer designated shipping point. If order provide shipping terms requesting delivery of products to a specific location, Metal Solutions will ship such products via method and carrier requested by buyers in such order as long as buyer request complies with Metal Solutions shipping and delivery policy.

 

SECTION 7.  DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not guarantee, represent or warranty that your use of our service will be uninterrupted, timely, and secure or error free. The purchaser agrees to hold Metal Solutions USA, LLC from any actions, lawsuits, judgments’, or liability claims arising from the use of these products. Metal Solutions USA, LLC is not responsible for any liability or losses.

You expressly agree that your use of, or inability to use, the service at your sole risk. The service and all products delivered to you through the service are (except as expressly stated by us) provided as is and as available for your use without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

 

SECTION 8.  PRODUCT QUALITY GUARANTEE:

Please inspect the packaging of your item(s) when they arrive, If you notice any damages you should REFUSE the package, and make note on the delivery receipt. If your item do arrive damaged, please contact us immediately and send photos to [email protected]. We will process an insurance claim on your behalf and happily work with you to resolve the issue.

 

SECTION 9. RETURN POLICY:

As stated in the Product Quality Guarantee, any item that arrives in less than perfect condition or missing parts will be handled at no extra cost. Returned products must be sent back in their original packaging and have all the parts and components they came with.

Customer is responsible for return shipping and original shipping cost

Please document (photograph) any damages upon receiving the item and report these damages to the delivery carrier if product was sent by LTL, or freight not by (UPS FEDEX or USPS, etc.). Returns must be accompanied with a RMA number, must be obtained from Metal Solutions. Should you have any questions about our return policy please contact us.
